Emotional Adieu to Ganesha

The week-long Ganesh Utsav celebrations in the sub-city, organised by the Maharastra Mitra Mandal, Dwarka, concluded with Ganpati visarjan at Hari Nagar lake. With visarjan, it was also a sad adieu to the euphoria and excitement of celebratory mood that reigned all through the utsav days. Amidst shrieks of ‘Pudhchya Varshi laukar ya'…….meaning come back soon next year, the idol was immersed on 23rd, Sunday. Before that, Puja was done at True Friends CGHS, the venue where the idol was installed. In the morning Satyanarayan puja and Maha Prasad was organised.

With much pomp and grandeur Ganapati Bappa was brought and installed at True Friends apartments, Sector-6, Dwarka on 15th September. The Maharashtrians are particularly passionate about Lord Ganesh and for them Ganesh Utsav is marked by an intense emotion. During utsav days, the Lord becomes family, to be worshipped with utmost love and devotion, before he is tearfully bid adieu. The festival celebrated by Maharashtra Mitra Mandal of Dwarka has definitely given a chance to Maharashtrians living in cosmopolitan Dwarka to go back to their roots and have a feel of their traditional culture, food and music. The Mandal successfully organized blood donation camp on 15th. Simultaneously exhibition of Uday Kulkarni, a renowned artist of Dwarka was also held which was inaugurated by Addll Commissioner of Police (Traffic) M.S. Upadhye. The utsav also served a platform for many talented people to showcase their attributes. Kasturi Attrawalkar, a resident of Dwarka captivated the audience by her melodious rendition of Marathi songs. The magic show on Wednesday was a complete hit amongst children. The venue was jam packed for the much awaited Kavi Sammelan organized by well known poetess Kirti Kale along with ten other poets. The kavi sammelan was enjoyed and appreciated by all. Vividha, an inhouse cultural programme of children was also a major attraction. All dances were choreographed by Chitra Vishwanathan. Children also enjoyed the play 'Tenaliram'. The interesting compering was done by Shashank and Divya.

CGHS Flat allotment Dwarka - latest developments

Dear members,

Congratulations! It is great news for all of us that the Delhi government has approved a cabinet note for granting general exemption to the members who were enrolled in violation of rule 24(2). We must praise the sincere efforts of the Hon'ble Chief Minister who had shown her keen interest in this matter. I must inform all the members that though the Judgment on rule 24(2) seems to be in our favour but RCS and the Government was in the opinion that the Court has not given any relief to the members. Soon after knowing the stand of RCS and the government, we started all out efforts to get the relief from the government rather than seeking clarification from the High Court. In the process, during the first week of July, we a group of members from different societies met Hon'ble Chief Minister and handed over a joint memorandum and made her aware of the sufferings of the members. She was quite convinced and assured us to bring the matter in the cabinet at the earliest. Since then we had met her 5-6 times and kept her requesting to expedite the matter. She was very positive and cooperative all the times. Even last week, we again met her and requested her to bring the matter in the forthcoming cabinet meeting. The group was quite active during last 3 months and had met many politicians and bureaucrats to expedite this matter of rule 24(2). It is important to mention here that the process of going to the Hon'ble C.M. has not only saved time but also saved us from the Burdon of the litigation cost which we had originally planned by moving to the High Court for clarification or filing a SLP in Supreme Court. We must also take the opportunity to thank the present Registrar whose positive attitude helped the Government to take the step to bring the general exemption in the cabinet.

Please inform other members also to come to Chief Minister's residence at 9 AM to show our gratitude to her.

The 7th international literature festival successfully held in Berlin

The 7th international literature festival berlin (ilb) came to an end Sunday evening with a musical poetry performance by actress and singer Jane Birkin. The consensus of the organizers is that these last 13 days devoted to literature went very well. In total, 34,000 literary enthusiasts attended the festival’s 254 events at the Haus der Berliner Festspiele and other venues, including the Instituto Cervantes, the Ibero-American Institute, and the Buchhändlerkeller. Exciting readings and discussions, films and concerts captivated audiences.

152 Authors from 51 countries were guests at the 7th ilb. Celebrities of the literary world such as Isabel Allende, Mario Vargas Llosa, Michael Ondaatje, Wole Soyinka, and David Grossman kept the theaters packed at the Haus der Berliner Festspiele; and other guests of the festival’s series Literatures of the World and Kaleidoscope – which included Chuck Palahniuk, António Lobo Antunes, Paul Muldoon, Jean Rouaud, Tishani Doshi, Aharon Appelfeld, Jorie Graham, Azar Nafisi and lê thi diem thúy – drew large crowds as well. A reading by Roberto Saviano, whose book “Gomorrha” reveals the structure of the Neapolitan Camorra, was a special experience made more powerful because of recent events.

The festival’s series International Children’s and Youth Literature, with its 100 events featuring respected authors and illustrators such as Liliana Bodoc, Kevin Brooks, Faïza Guène, John Kilaka, Guus Kuijer, and Marie-Aude Murail, will be remembered for its full houses, intense encounters, and moving moments. Young visitors were able to let their imaginations run wild. In total, more than 10,000 children, young adults, and grownups enjoyed these events.

Equally well attended were the discussions about Islamic culture, world cities, and the fall of Litwinenko in the festival’s series Reflections, and the three Poetry Nights, which included performances by Ales Rasanau, Patrizia Cavalli, Robert Gray, Marie Lundquist, Anne Waldman, and Sapphire.

Another success were the events of the Focus “Latin American Literature”. Literary works were read by both famous authors and new discoveries such as Ignacio Padilla, Amir Valle, Martín Kohan, Edgardo Cozarinsky, Guillermo Fadanelli, Reginaldo Ferreira da Silva (Ferréz), Santiago Roncagliolo, and Carmen Posadas.

The highlights of the musical portion of the festival were the Biermann Concert and the Tango-Nuevo Evening with Silvana Deluigi.

With its various theaters, its Café Nabokov, and an authors’ tent in the garden, the Haus der Berliner Festspiele once again provided this literary summit meeting with the ideal setting for inspiring interactions in a comfortable atmosphere.

„The festival was a great succes. I would like to thank the federal government and the city of Berlin for their continuing support, the Berliner Festspiele, the sponsors, my team, and above all the wonderful authors who took part in this year’s festival. I’m looking forward to the next seven years,“ said the Festival Director Ulrich Schreiber in conclusion.

The residents of Sector-14, Dwarka are living miserable life indeed

"We have 976 flats and we are facing various problems like poor water supply, blocked sewerage, street lights in our society". Says Mr. V.S.Bisht-The president of R.W.A. D.D.A. Flats Sector-14, Pkt.1. In a public meeting with T.V. Channel (Delhi Aaj Tak) the residents of the said pocket revealed lot inconvenience, even the Sushil Kumar-Gen. Secy. of the locality blamed the officials (M.C.D. & D.D.A.) who never take interest to solve their basic problems, the flats are built with poor building material that’s why the plaster as well as the roof, floors, stairs are broken and very risky to live in these flats. Although 20-25 water tanks come daily to fulfill the requirements of the residents but they provide underground water which is not hygienic at all. Even Mr.R.D. Ahirwal & Ashwani Kumar pointed out that we don’t have the proper approach as well inner roads. Moreover, the large bushes standing in the public park in front of the pocket, is also problem creating, because this is the approach road for Sector-13 Metro station, but its very insecure root for the females. The R.W.A. has written several letters to the different departments but the situation remain the same, there is no improvement at all. The local Counsellor –Mrs. Dhanpati Gahlout also attended the said meeting and she noted the grievances of the resident and assured them to solve their problems with in a months or so.

In fact, the connecting path to Metro stations are unsafe from many sectors. So the incidents like robbery, chain snatching etc. are increasing in Dwarka.

Nearby road connecting to Metro stations should be well - lit. There is darkness on the road connecting sector-9 metro station to ITL Public school. Many passengers have been attacked by the anti social elements. Metro authority should take up the issue with concerned authorities and ensure the safety of the passengers. It is learnt that many people are avoiding Metro due to this dirty, longer zig-zag and unsafe path

Suggestion from Dwarka Residents for Delhi Metro (DMRC)

The elevated infrastructure should not be misused for advertisement by private parties. The message should be in the national interest and encouraging for public and next generation.
Such regular survey/ feed back must be exercised. The Feedback will certain help an organization like DMRC with scope for improvement. The Metro is for the MASSES and every thing come with price and for development on need to adjust this is what my message to my fellow RWA members ( Sorry I beg to differ with you) who were objecting to it. YES it would have certainly better if its underground. However for the time being with current economy, we wont be able to afford it. Those RWA members who making noise forgotten one thing, look at their neighbors and their buildings?? What was its original/ approved shape and what it is today?

The area under the Elevated Metro track is being encroached by the people for their personal interest. It should have fencing both the side of dividers (pillers) and also should have GREENERY (small plants) in the area under the elevated tracks. It should be beautify so that it looks the best transport system of Delhi.

Metro Rail CONNECTIVITY should be there in most of the routes of DELHI especially the routes / area where traffic is in large volume and also nearby to the major commercial / institutional / working places like Nehru Place / Ring Road / Outer Ring Road. It will minimize the traffic on the roads and will be a great gift for the daily commuters.

In Dwarka subcity Metro is not connect to all the Sectors of Dwarka and most of the Metro Stations are at a distance of minimum 2-3 kilometre (approximately). Residents have to pay Rs. 15/- for Riksha to reach the Metro Station.

There was news that DMRC is going to run the Feeder Buses with GPS system. I am of the opinion that Feeder Buses should ply on the distance of around 5 Kilometres ONLY TO FETCH THE PASSANGERS OF THE NEARBY AREAS TO RESPECTIVE METRO STATIONS. There should be fixed charges of Rs.5 per person so that more & more people will be willing to travel through Metro..

I notice that the Metro’s RTVs are plying on the general routes to fetch the passenger and the condition of these RTVs are very pathetic, these are plying on the roads like Blueline Buses.

Firstly, Delhi's sweltering heat should be tapped by solar panels which can be installed on both sides of the tracks in overhead lines, and on the roofs as well. I know that the costs are gonna be too high, but some initiative must be taken and spread gradually to as much as possible. Only DMRC is expected to attain such a feat. It will be another feather in the overloaded cap of Delhi Metro's marvellous engineers. Research should be encouraged in this direction to bring down the costs as well as provide the best possible solution.

Secondly, the beautification of the piers on line 3 was supposed to be completed within six months of it's opening. But as we can see it, the progress is very slow. This step though, will help as an answer to those who say that overhead lines spoil the 'view'. I don't understand what view are they talking about when 80% of Delhi is unauthorised and much more of it an eyesore, save for areas like C.P etc. Only Dwarka has some rocking views and it was only after the birth of Delhi Metro that many beautiful 'views' that we see today sprung up besides it's tracks.

Thirdly, seeing the efficient working techniques of DMRC, they should take up more civil work across the city, (building roads, flyovers, slum relocation housing projects) not just to earn revenue, but to let the work be completed on time and within budget, minus any corruption.

Fourthly, trains should be stretched gradually to include more number of cars from the present case of 4 cars per train.

Last, but not the least, the DMRC site itself should have a feedback submission option, so that we can directly send our views and suggestions to the corporation.:

1) Station - wise energy saving plan should be chalked out and followed strictly. The money thus saved should be used in installing Solar - Panel so that at least 10 % of energy used at the station be from Solar Energy.

2) Commuters be identified and concessional fares be awarded to them for pointing out the
violators or the persons who damage/ spoil metro property by e.g. spitting etc. This shall
act as restraint and also incentives the commuters.

3) The timings on the clocks be practical - in terms of the display which signifies in how
much time the next train is coming.

4) Number of bogies must be increased from the existing or at least all the trains be made to move inside Dwarka rather than terminating at Dwarka more, because the passenger traffic has already increased significantly and this shall make the travel less hassle for the commuters from/ to Dwarka

5) To reinforce feeder services and strengthen the connectivity.

6) Nearby road connecting to Metro stations should be well - lit. There is darkness on the road connecting sector-9 metro station to ITL Public school. Many passengers have been attacked by the anti social elements. Metro authority should take up the issue with concerned authorities and ensure the safety of the passengers. It is learnt that many people are avoiding Metro due to this dirty, longer zig-zag and unsafe path.

1. Rule DB. With the consent of counsel for the parties, the writ petition
is taken up for final hearing.
2. This writ petition has been filed by the petitioner seeking the
following relief:
?(i) pass necessary orders, directions or writ more so in the nature of
writ of certiorari quashing the impugned order dated 19.12.2006 in case
No.RCS/F.1374/CGHS/NE/06/2833-2838 emerging from the Show Cause Notice being
No.F.1374/CGHS/NE/2006/99 dated 12.6.2006 purporting to be a Show Cause Notice
under Section 37 of the Delhi Co-operative Societies Act, 2003, the said notice
as well as the order made pursuant thereto being illegal and unsustainable.?
3. Counsel for the petitioner has contended that subsequent to the
impugned order dated 19.12.2006 passed by the Registrar, Co-operative Societies,
this Court has delivered a judgment in Rajib Mukhopadhyaya's case, being W.P.
(C) No.1403-14/2006. It is submitted by counsel for the petitioner that in view
of the law laid down in the said judgment, the issue involved in the present
writ petition stands fully covered by the said judgment and in particular
reliance has been placed on paragraphs 12 and 13 of the said judgment, which
read as follows:
?12. Consequently, we uphold the constitutional validity of Rule 24(2) of
the DCS Rules subject to the above interpretation of the law submitted by the
learned Additional Solicitor General, which we accept and declare. The bye laws
of the Society shall be fully followed in entertaining the claims of memberships
set up by those applying through the medium of Rule 24(2) of the DCS Rules.
Thus, if the society has any existing requirements in its bye laws about the
characteristics required to be possessed by an intending member, only such
persons possessing the requirements as stipulated in the existing bye laws and
regulations of the Society are entitled to apply pursuant to Rule 24(2) of the
DCS Rules. We also make it clear that if the Society has any existing members
who have still not got the allotment of a plot/flat, such members, in accordance
with the bye laws, shall be first allotted the vacant plot/flat/premises before
resort to Rule 24(2) of the DCS Rules. It is only when all such existing
members awaiting allotment have been allotted the premises/plot/flats, shall the
operation of Rule 24(2) of the DCS Rules come into being.
13. Consequently, while dispelling the challenge to the constitutional
validity of Rule 24(2) of the DCS Rules, we nevertheless uphold the societies
right to restrict its membership in accordance with the bye-laws, regulations
and the rules of the society prospective candidates and further make it clear
that any prospective entrant to a society, pursuant to the mandate of Rule 24(2)
of the DCS Rules shall only be eligible to be allotted a plot after the
requirements of the existing members are fulfilled.?
4. However, since in view of the provisions of the Delhi Co-operative
Societies Act, an appeal against the Registrar's order is maintainable under
Section 112 of the said Act, the petitioner is directed to file an appeal
against the impugned order of the Registrar dated 19.12.2006 under Section 112
and the said appeal shall be disposed of on merits by the Tribunal by applying
the law laid down in Rajib Mukhopadhyaya's case and in particular paragraphs 12

and 13 extracted above. The appeal shall be filed not later than four weeks
from today. The said appeal, if filed not later than four weeks from today,
shall be disposed of on or before 31st December, 2007 in accordance with the law
as declared above. During the pendency of the appeal before the Tribunal, the
impugned order dated 19.12.2006 shall remain stayed.
5. W.P.(C) 155/2007 and CM Nos.285/2007 and 10475/2007 stand disposed of

On 5th July, 2007, certain orders were passed in this matter about the
resolution of the dispute of an early allotment sought by the members, who were
not involved in any wrong doing. This order was passed by the Bench of Hon'ble
Mr. Justice Manmohan Sarin and Hon'ble Mr. Justice Sudershan Kumar Mishra.
Thereafter, on 11th July, 2007, further orders were passed, inter alia,
appointing Mr. S.M. Chopra, former Additional District and Sessions Judge as an
amicus curiae to assist the Court and his fees was tentatively fixed at
Rs.25,000/-, subject to further orders, to be paid by Delhi Legal Services
Authority. Delhi Legal Services Authority is directed to ensure that the order
of 11th July, 2007 is complied with not later than 15th September, 2007. Mr.

Bansal, counsel for the petitioner states that his clients are willing to bear
the further payment to Mr. Chopra, amicus curiae.

We may notice that the Division Bench of Hon'ble Mr.Justice Mukul Mudgal
and Hon'ble Ms.Justice Reva Kheterpal vide orders dated 22nd August, 2007 has
directed the Delhi Legal Services Authority to ensure that order dated 11th
July, 2007 for payment of fee of the Amicus Curiae Mr.S.M.Chopra which had been
tentatively fixed as Rs.25000/- is complied with latest by 15th September, 2007.
Mr.Chopra states that payment has still not received. We hope and trust that

Delhi Legal Services Authority would comply with the said order before the date
fixed by the Division Bench.
We have perused the interim report given by the Amicus Curiae and in
particular his recommendation at para 9(a) to (d).
Mr.Sumit Bansal, learned counsel for the petitioner states that he has
given the list of members comprising 64 resignations as mentioned in para 9(b)
with complete addresses and would also supply a list of 120 original members.
The Amicus Curiae will reconcile the list which would include consideration of
objections to certain members as pointed out by the learned counsel for CBI in
respect of 120 original members. Petitioner's counsel will make available
to the Amicus Curiae for despatch the necessary envelopes duly addressed and
stamped along with the required copies of the public notice. The Amicus
Curiae shall ensure the despatch thereof. Public notices shall be despatched
with covering letters from the Amicus Curiae to the effect that under directions
from the court notice as published in the Times of India dated 4th August, 2007
is being sent by Certificate of Posting and any objection or response thereto
may be sent to Mr.Gopal Krishan Sharma, Deputy Registrar (Writs), High Court of
Delhi within 10 days from the date notices are dispatched. This step is being
taken by way of abundant caution to avoid any objection at any subsequent stage.
Learned counsel for the petitioner submits that petitioner society would bear
the liability for any further fee of the Amicus Curiae.
Response to the interim report of the Amicus Curiae may be filed by the
Registrar, Cooperative Societies and the CBI, as desired by them before the next

grant of Occupancy Certificate in respect of Plot no.20, Sector-12, Dwarka,
Delhi vide their application dated 27th December, 2005 and deposited the
necessary charges. Respondent-DDA may process the application without

requirement to be complied with by the petitioner-society or deficiency may be
intimated to it. If the respondent-DDA finds the application in order, and
after the required inspection finds that petitioner is entitled to grant of
occupancy certificate, it may issue the same provisionally and subject to the
outcome of the writ petition and deposit the same in court. Learned counsel
for the petitioner submits that petitioner-society is willing to pay the
requisite charges for time extension. Let this be done within three weeks.
