OCCUPY YOUR FLAT FIRST, DECORATE IT LATER– ASOK KUMAR

On the occasion of Holi Milan at IDC Society, Sector 11, Dwarka, Mr. Asok Kumar, Convener, Association of Suffering Members of CGHS, and leading the campaign for self-allotments of flats to the eligible members, exhorted for starting living in the self-allotted flats immediately. He informed that in the self-allotted flats, there is no problem in getting water and electric connections and in many societies, connections have been given by the concerned agencies as for this, no POC is required. He gave a clarion call to immediately move in the self-allotted flats and the decoration and wood-work etc. may be undertaken later as the government is watching closely and is making discreet inquiries to ascertain the per centage of occupancy. He suggested that if some body is not in a position to move immediately due to certain reasons, in such circumstance, the flat should be given on rent. If the flats are occupied, it will not be easy to do anything adverse by the government and its threats will be hollow. Mr. Kumar said that the self-allotment has made the government to conduct remaining draws on priority basis but there are so many glitches, hiccups and Committees and each Committee takes its own time. One Committee holds its meetings only once in a month and if any Committee member is not available for the meeting, it is postponed to the next month thereby delaying the whole process. He informed that in the ‘workshop’, he brought the fact before the Chief Minister that some officials demand greasing the palms by saying that they have to share this up to top and Asok demanded an inquiry in to this. He said that if this may have happened in some other country, many heads might have rolled so far. Informing about the proceedings of the “work shop”, he said that on the demand of the representatives, Mrs. Sheila Dikshit, Chief Minister assured that the draw in future would be expedited but despite the assurance, this does not seem practical because of lengthy procedures and greedy officials. Mr. Kumar said for the suffering members should wait for the draw within a reasonable time and if the government departments fails in conducing the draw within a reasonable time, the only alternative is to conduct self-draw for which he assured all the assistance from the Associations of Suffering Members.

On this occasion, Mr Virender Kandwal, President, Appu Enclave cautioned the members for not falling in to the trap of RCS office, which is adopting all tactics to create confusions amongst the suffering members. On adopting the coercive tactics by the RCS, Kandwal informed that to cover its inefficiency in conducting the draws of eligible societies, RCS considered the self-draw held on 3rd January as a challenge to his authority. In its belligerent actions, it has taken various legal actions by abusing the process of law. One of the examples of sheer abuse of power is the registration of FIRs against the members of Managing Committees of various societies, which have conducted self-draw. He said that under the DCS rules, Managing Committees are competent to hold self-draw by adopting the prescribed procedure. On the sidelines of the get-together, Mr. Ashok Chaitanya, Advocate informed that he has filed a petition in the Delhi High Court on behalf of Appu Enclave for quashing the FIRs and there is no need to panic as they have put all the relevant facts before the Court. High Court has been informed about the indifferent attitude of RCS and other agencies in conducting the draw of the eligible societies. The case was patently heard by the High Court and it has directed to the Delhi government for filling the counter affidavit and the case is now listed for hearing on 21st April, 2010. Kandwal said that he is confident that these illegal FIRs will be quashed.

Mr. Rajender Arya, Advocate, Delhi High Court and members of Sapna Ghar society informed about the proceedings in the so-called “Work Shop” organized by the Chief Minister on 18th February, which was an attempt to save the corrupt officers and to re-establish the authority upon the suffering members. He said that no case of trespassing could be made out against a person for moving in own flats being lawful owner of the flats. These flats are neither the government property nor a private property. Mr. Arya also said that the provisions of Section 118 of the DCS Act, 2007 are ultra-vires and liable to be struck down by the judiciary because these are totally in violation of the law of land. There cannot be any trespassing for moving in to the flat owned by the self.

On this occasion Dwarka Forum Secretary, Mr. Sushil Kumar, Legal Advisor, Mr. Ashok Chaitanya, and Media Advisor, Mr. M. K. Gupta were also present to show solidarity with the suffering members of the society waiting for the draw.

Holi Milan was celebrated after appraising the latest position to the representative and members of the CGHS by giving a call to all to preserve unity.
