Dear Friends, especially the Residents, having interest therein & Well-wishers,
The time has come stand up for your rights and to snatch the fruits which you deserves and are yours by uniting yourself without fear thereby following the ideals and path shown by Mahatma Gandhi. As well all know that for the last more than 6-7 years we the innocent people who committed sin of seeing a dream of there house in Dwarka. The corrupt politician, the Government and the beouracats of this country have trapped us in such a position and creating such hurdles where there is no way out for our survival. So I appeal to all to stand up for your rights unitedly by justifying the saying of Marta kya Karta (Do or die).
I am a practicing lawyer for the last more than 35 years in the NCT Delhi. Fortunately or unfortunately I sought the membership of a CGHS Society in Dwarka and soon after landed in unending troubles creation of this corrupt politicians of this country totally hands in gloves with the corrupt administrative machinery . We, the people of India have changed our status as slaves of foreign power to this corrupt power of our own people. This power is more and more corrupt from the foreign power. The English people have some standards of morality and ethics, but what a destiny of this nation wherein our own blood has no moral values and acts more crudely and totally in inhuman manner. I am not hesitant to say that it is we the people, who have also become a part and parcel of this corrupt practice.
Now coming to the point as you all know that it is a matter of great satisfaction that the initiative to get our right to use our properties in Dwarka has already been started by Shri Asok Kumarji few months back. Shri Asok Kumar ji has been leading this movement under the umbrella of Association of Suffering Members of Group Housing Societies mainly in Dwarka. In this process, the members of about a dozen societies have entered into their own flats with unprecedented unanimity by holding jointly self-draw of flats by defying all sort of bureaucratic Draculian anti people orders, laws made by these corrupts in power to meet the ends of their lust of looting the people with both hand till they suck the last blood of innocent citizens of this country. I have found now that many other societies are not thinking of following the same path of self-draw. At this point of time a lot of people are hesitant and having fear of their bread and butter by anticipating any back lash from the beurocracy if going ahead with such plans. These friends of mine are hopeful that finally the justice will prevail and the judicial system of this country will come to the rescue of their fundamental rights being snatched by these corrupts powerful people. Though the judiciary of the country of has time and again in various matter pending or disposed off in the last 4-5 years had declared that all such persons who have put their money in their respective society for construction of flats are entitled for the enjoying the fruits and not by those objectors who had not cared to take any timely action to save their interests. But I am very sorry to say inspite of these clear cut orders that these crooked beurocarts with the support of the people in the present Government have been misleading the Judiciary since time immoral and have become master of subverting the judicial process according to their whims and fancies. If this is not true than why one after the other in Court proceedings these matter are being dragged on one or the other false and misleading pretext concocted by these people in power. On the other hand it is now the history of this nation that whosoever stood for his right with force had got the same legally by forcing these people by towing them with their lines. One more thing I tell you that these corrupt politicians and the beurocrats are very coward people having no principles in life, first these people come with full force to suppress you but when find the voice of the people becoming louder and louder they also put their arms and bow before the wishes of the people. I want to clear the following confusions in the mind of my friends:
1. By going for self draw we are neither committing any sin nor breaking any law of the land. We have every right to enter, use and enjoy our property made from our hard earned money and savings which no body on earth can deny us. This is our fundamental right given to us under the Constitution of India. Even an outlaw has a right to have his own house. But in this process we may have to face the irks of these corrupts people in power but rest assure these people will very soon lying flat on earth if we people keeps on maintaining and demonstrating our strength, unity and force.
2. The provisions of prosecution in DCS Act & Rules are totally ultra-vires, are the creation of this corrupt mind to use them as a weapon to create fear in the minds of people of 7 years imprisonment in case a person enters into his/her own house. Please do remember the laws are made for the welfare of society to run the same in a disciplined manner and not to suppress them. Any such law made in the past has always lick the dust. This Government had passed a rent law in 1994 but the successive Government since then had not dared to implement it even after passing of 16 years fearing the back lash of only a section of affected persons having business interest in Delhi simply with a fear of loosing vote bank.
3. Legally speaking how the judicially of this nation will accept this law to be enforced upon the people, when the law of land provides a maximum sentence of 6 months if a persons trespass in others property but how the judicially can justify to give license to these corrupts even to initiate the prosecution for 7 years imprisonment to a person entering into his/her own house.
So I personally feel that there is no moral or legal impediment or any kind of in the way of all of us to continue with our plans of self draw started in January, 2010 subject to the condition if we are united and will remain united for the sake of our own family, our colleague members and our society at large. In this process we have to give undertaking to each other by swearing on oath that we will remain united what may come.; We will mutually watch the interest of each other and we will abide by the laws of land. The Affidavit in this respect suggested pertains to these commitment made by all of us towards each other and their society at large. Please do remember that this commitment on Affidavit shall always be remain in the safe custody of the society and is not to be submitted to any authority. This Affidavit shall always remind you towards your obligations, duties towards each other of a society and to follow the path, guidelines approved by a society going for self draw.
At last but not the least, I tell you that our society had gone for self-draw with other 1-12 society in January,2010 and I am fully in occupation and possession of my flat without any fear or interruption by any authority along with all my colleagues members. I advise to all those members of the society who are still waiting for the Devine hope for their draw o flats should first act themselves then expect the fruits. Please remember that God helps those who help themselves. I welcome to all those who seek further clarifications from me in this respect.
