Having been in the Govt set up for more than 35 years, after getting engineering qualifications from one of the top institute of the country-IIT Delhi, I have experienced the following-
- Broadly, existing administrative system/bureaucracy, political system is insensitive to fairness, merit, is generally self interested & trying to promote the interests of their close-knit groups
-There is not much accountability of their actions/misuse of powers.
-Result-mis-governance
-Honest, meritorious, committed & dedicated officials[mainly] are badly affected!
-Because of raw deal to their career/establishment interests, they, at times, run from pillar to post and then are constrained to knock the doors of the Courts.
-Going to the Court is a Financial/nerve shattering experience!.
- Honest & Conscientious officials suffer for years & manipulative, networked, unscrupulous senior officers/colleagues abuse networks/powers for personal gains.-Result-Country`s infrastructure works suffer. Development funds get wasted in many many cases, due to poor- planning, design, award, execution, monitoring etc etc. & poor quality of works.
- -Despite big in-house Law Deptts, organizations, many times, field top private lawyers of the country to defend their cases in the Courts. This is done, as only state money/funds, are expended to field lawyers from outside.
This has resulted in-
. Abdication of duties by the involved senior officers, as they either take unfair decisions or delay the matters for years
-Clogging of courts with huge service- matters cases.
-Govt spending huge money on private lawyers fees, even on service matters .On the other hand , hapless honest employees, spend from their own meagre funds.
THIS IS UNFAIR & INEQUITIOUS PROPOSAL
In case the State lose the `service matters Case`, despite fielding top private lawyers, then State money spent on the LOST CASE, should be recovered from the personal funds of those officers who delayed the matters or did not take decisions, as per the laid down rules, thus forcing the employees to go to the Court.
WHAT MAY HAPPEN?.
-Send right signals in the administrative system
-Bring about accountability.
-Improve Governance
-Reduction of no of cases in the Courts, if we consider all India scenario/figures.
-Save thousand of crores of State funds per year, if these will be recovered from defaulting officers.
Bring about efficiency in the system.
